Fraud in consumer transactions is an important aspect of contract law for both sellers and buyers to understand Consumers need to be wary of schemes meant to trick and deceive them. Owners of businesses need to make sure they aren’t moving beyond “salesman’s puffery” and misrepresenting products or making false claims in an effort to sell a product. 1 ) Choose one of the scams listed and explain how you would argue it satisfies all of the elements of fraud discussed in the chapter. Make sure to note whether the misrepresentation is an outright lie. a concealment or silence and explain why or why not you think that a plaintiff would have good chance at winning a civil lawsuit with a cause of action in fraud.
2) How might you suggest a victim could use social media to fight back against these types of scams by the dealer? Keep in mind our discussions on defamation from Chapter 6. What would you suggest to the victim about what he might say on social media sites to make sure he himself won’t get sued by the car dealer for defamation?
