Miss. Richards, the plaintiff, is in court suing her employer, Grotto Inc. Miss Richards is

party. After leaving the party, she was in a car accident and received a ticket
for driving under the influence; she feels her company is responsible. She
claims the company is responsible because of promises the company broke
regarding transportation after the party. Her employer argues that it was Miss
Richards’ own fault for drinking and driving, and therefore they were not
negligent.

CONCEPT REVIEW:

negligence beginning on page 215. Recall that to win a negligence case, the
plaintiff must prove four elements: (1) duty, (2) breach of duty, (3)
causation, and (4) damages. A plaintiff who cannot establish all four of these
elements will be denied recovery. Throughout the video, listen to see whether
