Q.1 Roe v. Wade
What were the key elements of the court’s holding in Roe v. Wade? Should the stage of pregnancy determine a woman’s right to an abortion? What are the rights of fathers? Regardless of your personal opinions and religious beliefs on abortion, try to identify the legal principles and parameters outlined in your readings. We’ll refer to these as we continue our discussion this week.
(CLASS: we are going to be studying the classic case of Roe v. Wade in some detail. This is the case that established a woman’s right to having an abortion and is the one that is the subject of so much controversy surrounding the general subject of abortion.
What is so important to our discussion is the underlying reasoning of the court in making its decision favoring the right to abortion as a constitutional right. The reasoning of any court on the issue of novel ideas regarding fundamental constitutional rights are always subject to controversy. Because they are there is a possibility that the reasoning of the court may change in the future denying the same constitutional rights they may have established previously or establishing constitutional rights that it never established in the past.
This discussion will exemplify the position of the United States Supreme Court in deciding constitutional rights for the entire nation. Nevertheless, the decision interpreting the right to abortion as a constitutional right brings in many in other important considerations, including the fathers’ rights in an abortion and what is the impact of the conflict between the right to religious beliefs and the right to abortion.
Let’s concentrate on bringing in the reasoning of the Roe v. Wade decision in our discussion and then use this as a stepping board to the other important considerations that this decision has left open for either state regulation or legislation.

In Roe v Wade the Supreme court has decided two important things. The United States Constitution provides a fundamental “right to privacy” that will protect a woman’s right to choose whether to have an abortion. But this abortion right will be absolute. Roe v. Wade (1973) The supreme court case has protected a woman’s right to have, an abortion prior to the visibility of the fetus. The case has involved a texas statute that will prohibit abortion except when necessary, to save the life of a pregnant woman. The Supreme Court, with a decision written by Justice Blackmun, has recognized big privacy in interest in abortions except when necessary to save the life of a pregnant woman. that will be established in Griswold v Connecticut. (1965). At stake in this matter in this matter has the fundamental right of a woman to decide whether or not to terminate their pregnancy. The underlying value of this right will include decisional autonomy and physical consequences. The court divided the pregnancy period into three different trimesters., During the first trimester, the decision to terminate the pregnancy will be solely the discretion of the woman. After the first trimester, the state will be able to regulate or outlaw but not outlaw abortions. abortions in the interest of the potential life for the potential life except when it will be necessary to preserve the life or health of the mother. I do believe that every woman has a choice, to do what they would like with their body. On the other hand, should a mother have the right to take her baby’s life? I have mixed emotions about this topic

Good afternoon Professor and Class,
Women’s rights were drastically changed by this court case. It changed the lives of many women after Roe. Women now had the right to choose what was good for her body in her opinion. Not only did Roe change the fact that women could have an abortion, but it made it safer for women to have an abortion legally. The deaths during abortions decreased because they were able to do it legally and safely. In 1965 it was set in motion the use for married couples and single women to use birth control which would cut down on the need to have an abortion. This also helped in Roe’s case. It interested me to see how far back (as early as the 1800’s) the was being thought of and fought.

Roe v. Wade was a landmark decision on January 22, 1973. It cleared stated that a woman’s right to choose what she does with her body is protected by the 14th Amendment. The court separated pregnancies into 3 trimesters that had different rulings. The first Trimester was solely the decision of the mother and legal. During the second trimester the government can regulate the abortion if it is to protect the mother. During the third trimester, abortion is prohibited due to the fact hat the fetus may be able to survive on their own outside the of the womb.
Since then states have been challenging the decisions.
Today Governor Greg Abbott of Texas signed into law legislation that prohibits abortion once a fetal heartbeat is detected. It is called the heartbeat bill. This will ban most abortions that occur. Also it will allow individuals to sue anyone who is performing or supporting a woman’s choice to choose. This may permit individuals that support the right to life to bring a law suit against anyone supporting a woman’s right to choose. In 2020, Texas reported 53,000 abortions.
With the use of a vaginal ultrasound, a fetal heartbeat can be detected as early as 6 weeks. The law stating no abortion after heartbeat will eliminate abortions almost as soon as a woman finds out she has missed a period.
